that public approval of detailed development plans consti- <br />tutes an automatic approval of any variances that may be <br />involved. <br />4. Final plats will not be approved by the City until a <br />development agreement is entered into between the applicant <br />and the City. <br />D. Landscaping - Buffer Zone <br />The 100 foot wide buffer zone around the entire periph- <br />ery of the Owner's property except for points of access for <br />ingress and egrees on said periphery as it appears on the <br />Owner's Site Plan (Exhibit "A "), shall be maintained by <br />Owner as follows: <br />1. No alteration of the buffer zone shall be allowed <br />without specific City Council approval. <br />2. Owner shall allow said buffer zone to remain in a <br />substantially natural state. <br />3. Should any activities of the Owner in connection with <br />the overall development adversely effect the buffer zone, <br />the Owner shall do appropriate restoration within a reason- <br />able time. <br />E. Drainage and Utilities <br />Description: The drainage and utilities as approved by <br />the City Engineer as attached hereto as Exhibit "A ". <br />1. Easements for drainage or utilities may be requested <br />by the City. <br />2. Provisions for construction and financing of sanitary <br />sewer, public water, surface water drainage, and other util- <br />ities shall be made as required by the City. <br />F. Construction Order Component <br />Description: The Construction Order Component attached <br />hereto as Exhibit "A" is hereby approved. <br />Requirements: <br />1. All development shall proceed in accordance with an <br />approved development program and no building or, other <br />construction permits shall be issued except in accordance <br />with the program. <br />2. Preliminary development drawings and schematics for <br />Phases II and III shall be presented far enough in advance <br />to allow time for proper review prior to the need for <br />building and other required permits. <br />1(1 <br />
