MINUTES
CITY COUNCIL
OCTOBER 11, 2006
Allan noted that it appears if the sign were placed to face east and west
there would be no need for the vacation. She noted that signage for the
Kandice Heights projects face east and west.
The City Administrator reported Chat the City's ordinance requires Chat
signage be at least five feeC from the property line. He also noted thaC
RAB, LLC is concerned about visibility for the sign and feels the
alignment perpendicular to Country Drive would provide the most
visibility.
Blesener asked if the proposed vacation is for right-of-way directly in
front of 2935 Country Drive. The Administrator replied thaC it is.
Keis noted that the City has a sewer line within this right-of-way, and even
though the right-of-way vacation would occur, a sewer easement would be
maintained by the City. Keis pointed out that Chis puts the sign at risk
should there be a sewer problem.
The City Administrator noted that RAB, LLC would be required to sign an
agreement acknowledging the risk to the sign.
Keis asked if the City could allow the sign without vacating the right-of-
way. The Administrator noted that a Variance would be necessary, given
the Code requires signage to be on the business's own property. He also
noted that the City would still retain a minimum of 60-feet of right-of-
way, which would be adequate should Country Drive ever be widened.
Mr. Montour introduced the following resolution and moved its adoption:
RESOLP/TION NO. 2006-70-239 -CALLING FOR A VACATION
HEARING FOR A PORTION OF COUNTRY DRIVE RIGHT-OF-
WAY AS RECOMMENDED BY CITY STAFF TO BE HELD ON
WEDNESDAY, OCTOBER 25, 2006 AT 7:30 P.M.
The foregoing resolution was duly seconded by Allan.
Ayes (5).
Nays (0).
