MINUTES CITY COUNCIL OCTOBER 25, 2006 THAT IS INTERNAL TO THE SITE REFERRED TO IN THE SUBMITTALS AS SIGN NOI The foregoing resolution was duly seconded by Allan. Ayes (5). Nays (0). Resolution declared adopted. VACATION Mayor Blesener opened the Public Hearing to consider the Vacation of OF the westerly 11 feet of Country Drive as abuts Lot 1, Block 1, Country PORTION Side Terrace. It was noted Chat Dick Biagini, RAB, LLC has indicated OF agreement with the City's position that he would bear the cost COUNTRY associated with damage/removal/reconstruction of the sign. Blesener DRIVE also noted that the City would retain a drainage and utility easement over the Country Drive right-of-way proposed to be vacated. There was no one present from the general public wishing to comment on this matter. Upon motion by Montour, seconded by Keis, the public hearing was closed. Mr. Montour introduced the following resolution and moved its adoption: RESOLUTION NO. 2006-IO-253 -VACATING THE WESTERLY II FEET OF COUNTRY DRIVE AS ABUTS LOT I, BLOCK I, COUNTRY SIDE TERRACE SUBJECT TO RETENTION OF DRAINAGE AND UTILITY EASEMENTS, AND SUBJECT TO RAB, GLC ENTERING INTO AN AGREEMENT WITH THE CITY RELATIVE TO THE SIGN AS RECOMMENDED BY THE CITY ADMINISTRATOR The foregoing resolution was duly seconded by Allan. Ayes (5). Nays (0). Resolution declared adopted. SUP FOR Mayor Blesener opened the continuation of Public Hearing to consider IIOME a Special Use Permit for a home occupation providing spa services OCCUPATION including yoga, manicures, pedicures, and massage therapy as well as a & TEXT Text Amendment to Chapter 2202 relative Co massage therapy as an AMENDMENT - accessory use. It was noted that the Planning Commission and the City 140 ROSE Planner have recommended denial of the Special Use Permit and the PLACE - Text Amendment based on the commercial intensity of the proposed MARY VASQUEZ home occupation and the resulting impact on the residential neighborhood.
