MINUTES <br />CITY COUNCIL <br />OCTOBER 25, 2006 <br />THAT IS INTERNAL TO THE SITE REFERRED TO IN THE <br />SUBMITTALS AS SIGN NOI <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />VACATION Mayor Blesener opened the Public Hearing to consider the Vacation of <br />OF the westerly 11 feet of Country Drive as abuts Lot 1, Block 1, Country <br />PORTION Side Terrace. It was noted Chat Dick Biagini, RAB, LLC has indicated <br />OF agreement with the City's position that he would bear the cost <br />COUNTRY associated with damage/removal/reconstruction of the sign. Blesener <br />DRIVE also noted that the City would retain a drainage and utility easement over <br /> the Country Drive right-of-way proposed to be vacated. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Montour, seconded by Keis, the public hearing was <br />closed. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2006-IO-253 -VACATING THE WESTERLY II <br />FEET OF COUNTRY DRIVE AS ABUTS LOT I, BLOCK I, <br />COUNTRY SIDE TERRACE SUBJECT TO RETENTION OF <br />DRAINAGE AND UTILITY EASEMENTS, AND SUBJECT TO RAB, <br />GLC ENTERING INTO AN AGREEMENT WITH THE CITY <br />RELATIVE TO THE SIGN AS RECOMMENDED BY THE CITY <br />ADMINISTRATOR <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />SUP FOR Mayor Blesener opened the continuation of Public Hearing to consider <br />IIOME a Special Use Permit for a home occupation providing spa services <br />OCCUPATION including yoga, manicures, pedicures, and massage therapy as well as a <br />& TEXT Text Amendment to Chapter 2202 relative Co massage therapy as an <br />AMENDMENT - accessory use. It was noted that the Planning Commission and the City <br />140 ROSE Planner have recommended denial of the Special Use Permit and the <br />PLACE - Text Amendment based on the commercial intensity of the proposed <br />MARY VASQUEZ home occupation and the resulting impact on the residential neighborhood. <br />
