Licht <br />6 -22 -83 <br />ORDINANCE NO. 83- <br />AN ORDINANCE AMENDING SECTION 4.124 <br />OF THE CITY CODE PERTAINING TO CONDITIONAL USES <br />IN THE B -3 DISTRICT BY ADDING SUBSECTION (8) <br />GOVERNING CONVENIENCE GAS /GROCERY /FOOD ESTABLISHMENTS <br />City of New Hope, Minnesota <br />The City Council of the City of New Hope ordains: <br />Section 1. Section 4.124 of the City Code, Listing of Conditional <br />Uses, is amended by the addition of the following subdivision (8): <br />(8) Convenience Gas (No Vehicle Service or Repair), Grocery, <br />and /or Food Operation 5, provided that: <br />L£ O< 7Z£ se 4;/ofJAS <br />(a) The meta i3- -safes involve uses or activities which are <br />allowed in a 8-1, B -2 or B -3 District. <br />(b) 'Convenience /deli food is of the take -out type only and <br />that no provision for seating or consumption on the <br />premises is provided. Furthermore, that the enclosed <br />area devoted to such activity, use and merchandise <br />shall not exceed fifteen (15) percent of the gross <br />floor area. <br />(c) That any sale of food items is subject to the approval <br />of the City Sanitarian who shall provide specific <br />written sanitary requirements on an individual basis <br />for each proposed sale location. <br />(d) That the non - automotive sales shall qualify for and be <br />granted an annual food handling, retail sales license <br />or other license, as circumstances shall require, in <br />addition to the permit for a special use under the <br />zoning code. <br />(e) That the area and location including exterior, outside <br />space devoted to non - automobile merchandise sales shall <br />be specified and any expansion of the space or change <br />in location without an amendment to the permit shall <br />constitute grounds for revocation of the permit, after <br />a hearing before the City Council. <br />(f) The hours of operation shall be limited to six (6) <br />o'clock a.m. to twelve (12) o'clock p.m., unless <br />extended by the City Council. <br />36 <br />
