page 7 <br />Personnel Ordinance <br />(d) Employees who are absent from work and are being paid worker's <br />compensation insurance benefits shall be considered to be working for the purpose <br />of accumulating additional vacation leave or sick leave for up to six (6) <br />months of absence from work. No sick leave or vacation benefits will be earned <br />while receiving compensation payments for time exceeding six (6) months. <br />(e) In order to be eligible for sick leave with pay, an employee must: <br />1. Report promptly to such employee's Department Head the reason for <br />the absence. <br />2. Keep such employee's Department Head informed of such employee's <br />condition, if the absence is more than three (3) days duration. <br />3. Submit a medical certificate for any absence exceeding three (3) <br />days if required by the Department Head. <br />(f) The misuse of sick leave, such as claiming sick leave when physically <br />fit, shall be grounds for immediate dismissal. <br />(g) Sick leave shall not be granted for less than one -half day. <br />(h) Sick leave credit shall not accrue to any employee during any period <br />of suspension, layoff, leave of absence or other off payroll status. <br />(i) In lieu of sick leave pay, for any absence not exceeding two days, <br />an employee may elect to take leave without pay. <br />Sec. 13: Leaves of Absence. <br />(a) After receiving a recommendation of the Department Head, the City <br />Council may approve a leave of absence of an employee without pay for a period <br />which shall not exceed ninety (90) calendar days. <br />Sec. 14: Jury and Witness Duty. <br />If an employee is called to serve as a juror or subpoenaed as a court <br />witness, the employee shall receive compensation which will equal the difference <br />between the employee's regular pay and compensation paid for jury duty or <br />witness fees. Employees are expected to report for work in the City when they <br />are released from court during regular office hours and to make every effort <br />to complete the work assigned to them during the time they are serving as jurors <br />or witnesses. <br />Sec. 15: Military Service. <br />The provisions of Minnesota Statutes, sections 192.26 and 192.261, as <br />amended are hereby adopted as an ordinance pertaining to leaves of absence while <br />engaged in military service.
