classification to be written for said class. All position classifications are <br />subject to review and approval by the City Council. <br />209.090. Overtime. <br />(A) City Clerk and Building Official. These employees are exempt from <br />overtime requirements except as provided herein. No overtime compensation <br />shall be paid to the City Clerk and Building Official, but such employees <br />shall be entitled to compensatory time off on a straight time basis for each <br />hour worked in excess of forty (40) hours per week. <br />(B) Superintendent of Public Works. The Superintendent of Public Works <br />shall be exempt from overtime requirements, except as provided herein. No <br />overtime compensation shall be paid, but such employee shall be paid <br />additional straight time pay for all hours worked which are in excess of forty <br />(40) but not more than forty —eight (48) (eight hours maximum). For all hours <br />worked in excess of forty —eight (48) hours per week, such employee shall <br />receive compensatory time off at the rate of one and one —half hours <br />compensatory time for each hour worked in excess of forty —eight (48) hours per <br />week. <br />(C) Recreation Director and Assistants. These employees shall be paid <br />on an annual salary basis and shall not be entitled to any overtime <br />compensation. <br />(D) All Other Regular Employees. All such employees shall be entitled <br />to pay at the rate of time and one —half for all hours worked in excess of <br />forty (40) hours per week, or in lieu thereof, the employee may elect <br />compensatory time off at the rate one and one —half hours compensatory time for <br />each hour worked in excess of forty (40) hours per week. Use of compensatory <br />time shall in all cases be subject to the needs of municipal service and prior <br />approval of the employee's Department Head. Each Department Head shall be <br />responsible for providing the City Clerk with an accurate accounting of all <br />such hours worked by an employee. This section is subject to this exception. <br />An employee who works in different job functions within the municipal service <br />in both a full time and part time capacity shall not be entitled to any <br />overtime for work performed as a part time employee until such employee's <br />total hours worked (both full and part time) in a work week exceed forty —eight <br />(48) hours. Thereafter, such employee shall be entitled to pay at the rate of <br />time and one —half for all hours worked as a part timer, which cause his /her <br />total hours to exceed forty —eight (48) hours, with payment for such overtime <br />hours to be based on his /her rate of pay as a part time employee. <br />(E) Use of compensatory time by Department Heads shall be subject to the <br />prior approval of their respective Council liason — person. An accurate <br />accounting of all such hours accrued and used shall be given by each <br />Department Head to the City Clerk for filing. <br />(F) It shall be the duty of the City Clerk to obtain from Department <br />Heads and to maintain on file accurate records for all employees, showing the <br />amount of compensatory time accrued and used by each City employee. <br />
