TRS <br />Planning <br />Commission <br />.Tan. 5, 1.013 <br />Cordie Howe <br />Variance <br />(Cont.) <br />The Planner reported that Mr. Howe will need a conditional use permit <br />in order to construct four- plexes in an R -2 zoning district. The <br />Planner reported that the property was previously zoned R -3 and was <br />down -zoned to R -2. <br />The Planner also stated that the variance is minimal and reported <br />that to the north of Lot 1, on which the variance is required, is <br />the Old County Road C right -of -way. Mr. Howe is also requesting <br />that he be allowed to tie into the driveway that is currently m <br />located over this right -of -way.' The Planner pointed out that the <br />right -of -way is 66 feet wide that this exceeds the City's requirements. <br />Mr. Ler1ay asked who owned the right-of-way. The Planner was not sure <br />whether it was owned by the City or County and stated that there was <br />no reason why the developer could not request that it be vacated. <br />The Planner also stated that the proposed land use was appropriate, <br />and the variance justifiable. <br />The Planner then reported that Mr. Howe is proposing to have <br />joint driveways for Lots 4 and 5 and Lots 2 And 3, with Lot 1 <br />using the driveway on the Old County Road C right -of -way. The <br />Planner stated that from a planning prospective joint driveways <br />were good. However, Mr. Howe is proposing 16 feet driveways and <br />the Planner recommended that the driveways be at least 20 feet wide. <br />The Planner also suggested that the developer he required to submit <br />a legal agreement for the maintenance of these driveways. <br />The Planner stated that the City Attorney has suggested that Mr. <br />Howe submit a hold harmless agreement to the City for anything that <br />could occur on the driveway that crosses the Old County Road C <br />right -of -way. The agreement should also contain a provision that <br />the property cannot be claimed by adverse possession. <br />Le' ?ay asked who this driveway would be shared with. Wr. DeLonais <br />stated that it is 'dally Tierreau's driveway. <br />The Planner reported that the orr1inance requires 3 parkin, spaces <br />Par oath Four -pLcx. The ?Canner pointed out that the narking is <br />provided in front of the garages. The Planner suggested that these <br />snares he provided on the other side of the parking lot. Also the <br />parking area does not have adequate width. <br />'ir. Matson then stated that the units have no storaga space provided. <br />The Planner suggested that no outdoor storage he allowed and suggested <br />that the plans he redrawn to provide for some additional storage <br />space. <br />The Planner stated that the above is all included in the recommendations <br />contained in his written report. <br />The Planner also reported that Mr. Howe has submitted a landscape plan <br />1' <br />
