MINUTES <br />PLANNING COMMISSION <br />JUNE 8, 2006 <br />Enterprises, was in agreement with all the conditions of the CUP. The <br />Administrator noted Peterson's comments at the December 9, 1999 <br />Planning Commission meeCing..."PeCerson pointed out that the City would <br />have control over the business, and should there be a problem with it, the <br />City has the abiliCy to revoke the CUP". <br />The Administrator again noted the City's enforcement efforts at this <br />property, and that staff is recommending revocation of the CUP's based on <br />the existing violations as well as the enforcement history of this site. The <br />Administrator summarized this history and also pointed out that in 2003 <br />Valor Enterprises applied for an amendment to their CUP to relocate the <br />sales lot to the front yard, reduce parking requirements, and allow up to <br />150 cars as outdoor storage. The Planning Commission Cabled the requesC <br />and suggested the property owner submit a "more realistic" proposal. The <br />property owner also indicated ChaC he would be doing his own engineering <br />sCUdy of the drainage of his property as he did noC agreed with the City <br />Engineer's findings. The property owner subsequently submitted a new <br />site plan showing 120 cars for outdoor storage, and indicated that he <br />would not be doing an engineering study. In May of 2004 the Amendment <br />to the CUP was denied. The owner indicated in December of 2004 that he <br />cannot operate his business in compliance with the conditions of the CUP. <br />Code enforcement efforts have continued, and on May 1, 2006, the <br />property owner was issued citations for violations of the CUP and <br />noncompliance with paving requirements. The Administrator stated that it <br />is staff's position that Valor Enterprises cannot attain and maintain <br />compliance either now or in the future based on the operational history of <br />the business as well as comments made by the owner, Fred Sedaghet. The <br />Administrator then reviewed a series of photographs depicting the <br />condition of the property. <br />Knudsen stated Chat iC appears there is no standard that has been imposed <br />Chat Valor Enterprises can meet at this point given the condition of Che <br />property, and the owner's history. <br />The CiCy Administrator reported that Chere have been points in time when <br />the owner has brought the property into compliance. However, it was <br />apparent vehicles were moved temporarily off site and then returned to the <br />site once City licenses were issued. <br />Fred Sedaghat, owner of Valor Enterprises, apologized for having to be <br />here again this evening. Sedaghat reported that since he moved to Little <br />Canada, there has been issues with his property. Sedaghat reported that, to <br />date, he has been able to work these issues out with the City and has <br />brought his property into compliance.
