MINUTES <br />Planning Commission <br />November 10, 1988 <br />Frattalone <br />Rezoning <br />Request <br />(Cont.) <br />Frattalone pointed out that with these restrictions on his property, the <br />value of his building is cut in half. <br />Frattalone also pointed out the property improvements he has made at the <br />City's request such as concrete curbing and fencing. Frattalone pointed <br />out that he constructed a block building and installed a 9 -ton road. <br />Frattalone was concerned that Councils change and even though his use <br />is grandfathered in now, if he wants to make a property improvement he <br />would need a special use permit and another Council may not want to grant <br />him such an improvement. <br />Frattalone pointed out that the property north of his remains I -1 and he <br />felt his property should be I -1 as well. Frattalone pointed out that he <br />has poor soils on his property. <br />Frattalone pointed out that with the I -P zoning, if his building were to <br />be empty for 6 months, he would lose his grandfather rights. <br />Frattalone stated that the rezoning took place very rapidly and he did not <br />have an opportunity to consider the effects of the rezoning fully. Frattalone <br />pointed out that he was forced to relocate from his other building because of <br />improper zoning, and he did not want the same thing to happen again. <br />DeLonais agreed with Frattalone's position, pointing out that the type of <br />business he has requires outside storage. <br />Frattalone commented that he is not saying that the City will put him out <br />of business, and he realizes that his business is grandfathered in. <br />However, he was concerned about the future and his investment in his <br />property. <br />Costa agreed that Frattalone had legitimate concerns. Costa asked why the <br />Council was initiating rezonings feeling that rezonings should be at the <br />request of the property owner. <br />The Planner pointed out that the I -P zoning does not change the use of the <br />property except for eliminating auto body repair. <br />Costa pointed out that property owners purchase their property for the <br />zoning it has, and did not believe it fair to change the zoning at this <br />time. <br />DeLonais also felt it not fair to limit the expansion of the non - conforming <br />buildings in the I -P District to 25% of their existing floor space. <br />The Planner stated that he can understand Frattalone's concerns. However, <br />outdoor storage has been a problem for the City in I -1 areas. The Planner <br />noted that this outdoor storage has an effect on surrounding property <br />values. <br />Page 6 <br />
