MINUTES <br />Planning Commission <br />July 14, 1988 <br />Stadler Mr. Thomas Stadler, 2837 Noel Drive, appeared before the Commission <br />CUP requesting approval of a Conditional Use Permit so that he can move <br />an existing garage onto his property. Stadler reported that his current <br />garage would be removed from the property. <br />The City Planner reported that the Stadler's existing garage is 7 1/2 <br />feet from the property line. Stadler is proposing to move the new <br />garage onto the existing slab on which the old garage had set. However, <br />in order to do this a 2 1/2 foot variance would be required. <br />The Planner explained that in April the City Council amended the ordinance <br />to allow houses and attached garages constructed prior to 1980 to be <br />rebuilt if damaged or destroyed with the 5 foot setback that was in <br />existence at that time. Council has discussed this matter and is of <br />the opinion that this should apply to detached garages as well. If <br />the City amends the ordinance to include detached garages, a variance <br />will not be necessary in Mr. Stadler's request. <br />Mr. Herkenhoff recommended adoption of an ordnance amending Section 905.050 <br />of the Little Canada, Minnesota Zoning Ordinance regarding side yard <br />setback requirements in R -1, Single - Family Residential District. <br />St. John's <br />Church <br />Rezoning <br />Motion seconded by Costa. <br />Motion carried 6 - 0. <br />Davison asked what the timeframe would be for removing the existing garage. <br />The City Planner replied that the existing garage would have to be removed <br />at the same time the new garage is moved in. This will be at the discretion <br />of the Building Inspector as to how expedient the removal will be. <br />Mr. Herkenhoff recommended approval of the conditional use permit requested <br />by Thomas Stadler, 2837 Noel Drive, in order that he can move an existing <br />garage onto his property subject to compliance with the recommendations <br />of the City Planner as contained in his report dated July 7, 1988. <br />Motion seconded by Mr. Costa. <br />Motion carried 6 - 0. <br />Sister Shirley, St. John's Church, appeared before the Commission <br />requesting the rezoning of the convent property to RB so that it can <br />be used as temporary housing for refuge families. <br />Costa asked why a rezoning was necessary. <br />The City Planner explained that under the current Public zoning, the <br />property can only be used residentially by persons employed by the <br />Page 6 <br />
