The PUD process is a development alternative that provides
greater flexibility for development by incorporating a mixture
of densities /intensities, or use types, while also allowing
variations from the provisions required by the Zoning Ordinance.
This proposal, because of existing conditions, appears to be an
applicable situation for a PUD that will benefit the City as well
as the developer.
Attached for reference: Exhibit A - Site Location; Exhibit B-
Empire Rebar Site Plan.
Development Stage:
Requirements of the Concept Plan approval as granted by the City
Council will be discussed later in this report. The development
stage of the PUD process requires the applicant to provide a more
specific and detailed plan for development. This submittal
requires a revised plan that illustrates all requirements placed
on the Concept Plan by the City Council.
The final step in the process is the Final Plan that is intended
to add detail to, and finalize the Development Stage Plan. The
Final Plan is to serve as a permanent public record of the PUD
and how it will be developed.
PUD DESIGNATION:
The subject site contains several legally existing non -
conformities, that are listed below. The City Zoning Ordinance
prohibits expansion of non - conforming uses and structures. The
only way expansion can occur at this site is by PUD. In a PUD,
the City can allow variations from the strict interpretation of
the Zoning Ordinance, thereby allowing the applicant greater
development flexibility. The trade -off is that the City can
demand higher standards from the applicant in regard to site
design; area improvements; and amenities.
By granting this PUD, the City will be giving some concessions to
the developer but also receiving improvements in the Woodlyn
Avenue area that has long been targeted for public and private
improvements.
The following conditions necessitate a PUD designation:
Non - conforming Use - The R & S operation includes both auto
repair and auto salvage. In November 1984, the City Council
passed Ordinance Number 243, which deleted auto salvage as an
allowed use. Since this date, R & S Auto Salvage has been a
legal non - conforming use; "grandfathered" in.
Also, the property in question has two existing principal
buildings and uses. This is prohibited by the City Zoning
Ordinance.
Page 91
