MINUTES <br />Planning Commission <br />August 11, 1988 <br />Conley <br />Auto Repair <br />& Sales <br />The Planner replied that that case could be made. However, the Planner <br />stated that the Ordinance doesn't recognize a freeway location as a <br />reason for a higher sign. The Planner pointed out the previous Council <br />action in the Unical request for replacement of signs due to a franchise <br />change. The City allowed the existing signs, which exceeded height <br />limitations, to be replaced with new signs. <br />Schweizer asked if the City would be setting a precedent by approving <br />this request. <br />The Planner replied that in similar cases with the same basic facts, a <br />variance request would warrant approval. However, the Planner stated <br />that he was not sure there were other areas in the City with similar <br />situations. The Planner did point out the previous request by McDonald's <br />for a sign variance and the fact that at the time McDonald's indicated <br />that they would buy frontage on Highway 36 in order to get a higher sign. <br />Davison asked why the Movers Warehouse sign is allowed to be higher than <br />the FinaServe sign. <br />The Planner replied that free - standing signs are graded by the size of the <br />building. The FinaServe building is approximately 2,500 square feet in <br />size while the Movers Warehouse building is 12,000 to 13,000 square feet <br />in size. <br />The Planner stated that it is his feeling that the situation is similar <br />to that of the Unical request and the same basic facts are present. <br />However, the Planner pointed out that his office recommended denial of <br />the Unical request. <br />Mr. DeLonais recommended approval of the FinaServe conditional use permit <br />request to replace their existing 30 foot high sign with a new 30 foot <br />high sign based on past precedent set in the Unical request and the <br />fact that the FinaServe property has exposure to Highway 36. <br />Motion seconded by Davison. <br />Motion carried 5 - 0. <br />The City Planner reported that he has no information on the William Conley <br />request for conditional use permit for auto repair and sales in Ryan <br />Industrial Park. The Planner stated that he had concerns with a retail <br />car sales operation in Ryan Park. It has also come to the attention of <br />the City that there is a business operating in the same building that <br />Conley is proposing to occupy that the City knew nothing about. <br />The Planner recommended that the request be tabled at this time pending <br />additional research and information. <br />Page 5 <br />
