The first step in the PUD process is the general concept stage. <br />At this stage, the applicant is required to submit general <br />information in written and graphic form to familiarize the <br />Planning Commission with the existing situation and to provide <br />insight regarding the applicant's intention regarding development <br />of the site in question. <br />The next step is the development stage. This stage requires the <br />applicant to provide a more specific and detailed plan for <br />development. The Planning Commission will make its <br />recommendation to the City Council based on this plan. <br />The final step in the PUD process is the final plan. This plan <br />is intended only to add detail to, and finalize the development <br />stage plan. The final plan is to serve as a complete, thorough <br />and permanent public record of the PUD and the manner in which it <br />is to be developed. <br />PUD DESIGNATION: <br />The subject site contains several legally existing non - <br />conformities, that are listed below. The City Zoning Ordinance <br />prohibits expansion of non - conforming uses and structures. The <br />only way expansion can occur at this site is by PUD. In a PUD, <br />the City can allow variations from the strict interpretation of <br />the Zoning Ordinance, thereby allowing the applicant greater <br />development flexibility. The trade -off is that the City can <br />demand higher standards from the applicant is regard to site <br />design; area improvements; and amenities. <br />By granting this PUD, the City will be giving some concessions to <br />the developer but also receiving improvements in the Woodlyn <br />Avenue area that has long been targeted for public and private <br />improvements. <br />The following conditions necessitate a PUD designation: <br />Non - conforming Use - The R & S operation includes both auto <br />repair and auto salvage. In November 1984, the City Council <br />passed Ordinance Number 243, which deleted auto salvage as an <br />allowed use. Since this date, R & S Auto Salvage has been a <br />legal non - conforming use; "grandfathered" in. <br />Also, the property in question has two existing principal <br />buildings and uses. This is prohibited by the City Zoning <br />Ordinance. <br />Non - Conforming Buildings - The Meyer Enterprises building is non- <br />conforming because it does not meet "I -1" district front or side <br />yard setback requirements. <br />Page 29 <br />
