MINUTES <br />PLANNING COMMISSION <br />DECEMBER I4, 2006 <br />Sculley stated thaC he hoped he was not just being told something to <br />comfort him in his old age. Sculley stated that he has seen the property <br />change from property that could be farmed to a wetland. He indicated that <br />he does not want any more water on his property, nor does Dave <br />Himmelbach. Sculley stated that until someone looks at the slopes they <br />cannot understand the concern. <br />Gary Quam, 2934 LaBore Road, thanked the developer for a vastly <br />improved plan. He noted, however, that the water issues being raised this <br />evening are valid issues. Quam pointed out that even though his property <br />is high, they had Co do a lot of landscaping around their house to diverC <br />water. Quam was also concerned about having a holding pond on the side <br />of a hill. He indicated that water is a big issue in this area. Quam asked <br />the value of the houses that would be constructed on the Richie properly. <br />Soby replied that the lots will sell in the $180,000 to $200,000 range. The <br />estimated home values will be from $575,000 to $800,000. <br />Quam stated that he would like Co see the area remain as is, but recognizes <br />the land owner's rights. He felt Lauren Development has done a nice job <br />in complying with the City's Comp Plan and working within the City's <br />Codes. Quam hoped that the developer would work with the City <br />Engineer to resolve the drainage concerns. Quam stated that he was not <br />opposed to the setback variance discussed this evening. <br />Rheaume asked if there was any recourse for property owners in the event <br />that the development goes in and it is later found that drainage is not <br />working. The City Planner replied that the City has specific standards that <br />will have to be complied with, and these standards are more stringent than <br />they were several years ago. The Planner indicated that there are Cimes, <br />however, when the natural conditions overwhelm the design of a storm <br />sewer system. There would be no recourse in that situation. However, if <br />the storm sewer system is designed improperly, there would be recourse <br />for surrounding property owners. The Planner noted that it is the City <br />Engineer's job to see that the design is property and that the system is built <br />to specification. <br />Bernie Kuperschmidt, 2945 LaBore Road, reported that there is a lot of <br />traffic on LaBore Road and fe1C that there should be some traffic control <br />measures to warm people that come around the LaBore Road curve. <br />Quam asked who owns the existing holding pond that Mr. Sculley referred <br />to. John Sculley replied that the property owners do and the pond is on <br />his, the Himmelbach, and Che Richie property. Quam indicated that this is <br />6 <br />
