MINUTES <br />Planning Commission <br />Jan. 14, 1988 <br />Warren Fritze report dated September 28, 1987 and due to the fact that the City <br />CUP (Cont.) has vacated Lake Street between Spruce Street and Park Street. <br />Motion seconded by Mr. Davison. <br />Motion carried 6 - 0. <br />Gardner <br />Bros. <br />Lot Split <br />& Sign <br />Variance <br />Mr. David Heller, representing Gardner Bros., appeared before the <br />Commission requesting approval of a lot split of the Gardner Bros. <br />property on Centerville Road. Heller explained that Gardner Bros. <br />has a total of about 7 acres and would like to divide approximately <br />2.3 acres from the site which would be sold to Larry Lee. Heller <br />reported that Gardner Bros. would provide the necessary easements <br />as required by the City. <br />Costa asked about the necessity for ponding on the property. <br />Heller indicated that the City Engineer has stated that a holding <br />pond may be required on the western portion of the property near <br />Centerville Road. <br />Costa asked how much of the property was buildable. <br />Mike Felix, representing Heritage Development which is a part of <br />Gardner Bros., reported that he did not know how Larry Lee intended <br />to develop the property he is buying. However, Gardner Bros. has <br />development plans for the approximately 5 acres of property that they <br />would retain. <br />Timmons asked if the property Gardner Bros. was selling to Larry Lee <br />was buildable. Timmons was concerned that if the property was not <br />buildable and the City approved a lot split, the City could be forced <br />to allow the site to be built on. <br />Mike Felix stated that it is up to Larry Lee to justify the development <br />of this site. Felix reported that Lee does not intend to build under <br />the power lines nor in any easement areas. <br />Timmons pointed out that if the City approves the lot split and the <br />property is not buildable, Larry Lee can argue that the City created <br />the lot and, therefore, it was assumed that the property was buildable. <br />Felix again stated that it is the property owner's responsibility to <br />justify later on whether or not a property is buildable. <br />Costa asked if a portion of the Gardner Bros. site was sold to Slumberland. <br />Felix replied that Gardner Bros. sold Slumberland an easement of 45 feet <br />along the southern property line in order that Slumberland could meet <br />setback requirements. <br />Page 2 <br />
