MEMORANDUM <br />northwest associ2ted consultants, inc. <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: 5 April 1988 <br />RE: Zoning Ordinance Amendment - Side Yard Setbacks <br />FILE N0: 758.09 - 88.18 <br />The Council has directed our office to prepare an amendment to the Zoning Ordinance <br />further clarifying the side yard setback allowances for property developed prior <br />to June 25, 1980 when the setback was changed from five to ten feet. The wording <br />established last spring stated that existing lots and houses could expand to within <br />five feet of an existing lot line. <br />A number of circumstances have arisen over the past few years where a house, built <br />prior to 1980, was placed on an oversized lot apparently in reliance upon the five <br />foot setback to allow adequate area for future subdivision. With the change to ten <br />foot side yard requirements, the subdivision could no longer occur without a <br />variance, which the City has been reluctant to grant.
