Little Canada Planning Commission <br />Little Canada Mayor and City Council <br />2 August 1984 <br />Page Two <br />2) The lot is in separate ownership from abutting lands. <br />3) All sanitary and dimensional requirements are complied with <br />insofar as practical (no less than seventy (70) percent of <br />the width and setback requirements). <br />The property in question is unable to meet any of these conditions. More- <br />over, if the property is resubdivided as proposed, they would be considered <br />newly platted lots. We must therefore evaluate the proposed subdivison and <br />variance per specifications of the Shoreland Overlay District. <br />The westerly lot proposed would be approximately 4800 square feet and 80 <br />feet wide. The easterly lot proposed would be approximately 5475 square feet <br />and 73 feet wide. This parcel also has an existing house with a front yard <br />setback of 7 feet and a rear yard setback of 23 feet. <br />While a variance for the proposed subdivision could be based on the fact that <br />this whole area is substandard with regard to lot area and setback require- <br />ments, none of the nearby properties are as extreme as the proposed lots. <br />Lot area is barely one -third of that required. The lot depth is not suffi- <br />cient to accomodate the required setbacks even without any building. Al- <br />though no topographic information is provided, a site inspection has con- <br />firmed a severe slope which would probably require a considerable amount <br />of fill to be buildable. The limited setback from Little Canada Road creates <br />a hazardous traffic situation and the addition of another buildable lot will <br />further jeopardize public safety. <br />RECOMMENDATION <br />The proposed subdivision does not meet the requirements outlined in the <br />Zoning Ordinance. A variance does not appear justified.
