MINUTES <br />Planning Commission <br />April 12, 1984 <br />Villeaux & <br />Peterson <br />Rezoning <br />Mrs. Peterson stated that she intends to stay living where she <br />is at, but is afraid of vandalism. <br />Karen Peterson informed the Commission that they want to rezone their <br />property because they are concerned that in the event of a disaster, <br />they will not he allowed to rebuild. Peterson stated that they <br />intend to remain living in their home. Peterson stated that it <br />is a nice neighborhood, and they want it to remain so. <br />Mrs. Nardini stated that the topic of non - conforming uses came up <br />briefly at the Council meeting last night. Nardini stated that <br />under a conditional use permit, the City can allow a non - conforming <br />use to he rebuilt. Nardini asked if the Council had the power to <br />change the ordinance. <br />The Planner replied that it did. Mr. Licht stated that he strongly <br />objected to an across- the -board grandfathering in of all homes in <br />A -3 areas. Licht stated that if it is a residential use of 3 -3 <br />property, the zone should be changed to residential. <br />Mr. Ducharme felt that the ordinance was unfair to these people. <br />Mr. Licht suggested that if there is a zoning change, it should <br />not be confined to these properties. Mr. Licht suggested that <br />R13 zoning would provide for the residential use, but also allow <br />for an office building. Licht pointed out that there is 3 -3 zoning <br />across the street. Also the trailer park is grossly in violation <br />of setbacks. <br />Mr. Licht pointed out that if this property is rezoned to R -1, it <br />will face the same question that the R -2 property is now facing. <br />Mr. Costa asked the property owners if they would be interested <br />in R13 zoning. Mr. Villeaux stated that he would if he were not <br />able to get R -1 zoning. Mr. Villeaux also pointed out that at <br />the time the trailer park was built, it was considered a business, <br />and as such could build up to the property line. Mr. Villeaux <br />stated that he would he agreeable to rezoning the back portion of <br />the trailer park to R -4. <br />Mrs. Timmons pointed out that the R13 zoning would give the property <br />owners added benefits than R -1. <br />Mr. DeLonais pointed out that the Villeaux property could become <br />an office building, and then the Peterson property would be <br />sitting in the middle. <br />Karen Peterson requested that should their property be rezoned to <br />R3, she would like the City to consider rezoning the property to <br />the north as 1113. <br />Mr. DeLonais asked the uses allowed in R3. <br />Page -4- <br />
