MINUTES <br />Planning Commission <br />April 12, 1984 <br />Empson Mr. Donald Empson and Ms. Kathleen Vadnais appeared before the <br />Earth Commission and reported that they own Lots 17, 18, 19, and 20 on <br />Sheltered Park Street. Their question is when Mr. Johnson choses to sell <br />Home the back of his property if he will be granted a variance for a <br />lot less than 10,000 square feet. <br />Empson reported that they propose to build an earth - sheltered home <br />facing south. They are concerned about another house being built <br />to the south and interfering with their solar access. <br />The Planner stated that as he interpreted a resolution passed by <br />the Council regarding the Johnson property was that if Mr. Johnson <br />has enough property to subdivide a conforming lot, then he must <br />meet square footage requirements. Mr. Johnson could not subdivide <br />a substandard lot just because he choses to do so. <br />Mr. Empson stated that they needed 40 feet between their proposed <br />horse and another on the south so that solar access will not be <br />interfered with. <br />The Planner pointed out that any building to the south would have <br />to meet City Code and would have to meet a 10 foot setback requirement <br />on the side yard. <br />Empson stated that the house they planned to build was an expensive <br />one and they were also concerned about the value of the house that <br />might be built to the south. <br />Mrs. Timmons suggested that perhaps Empson should buy one of Mr. <br />Johnson's lots. <br />Ms. Vadnais stated that the assessments are high on the property <br />and they have not been able to deal with Mr. Johnson. <br />Mr. Licht stated that the Council resolution does not waive the <br />setback requirement and the house to the south would have to be <br />at least 10 feet from the property line. <br />Vadnais asked if they could have a variance to build more to the <br />east and the house to the south be required to build as far <br />forward as possible. <br />Mrs. Nardini suggested that the only way to control the property <br />to the south would be for Empson to purchase it. <br />Empson felt that if four lots would have to be combined, that the <br />house to the south would not be as close to their's and the value <br />would be higher. Mr. French replied that even with four lots, <br />the house could still be 10 feet from the property line and of <br />whatever value the owner choses. <br />Page -10- <br />
