MINUTES <br />City Council <br />Dec. 14, 1988 <br />Cellular One and the City's water tower is 185 feet in height. <br />(Cont.) <br />Carroway stated that if Cellular One <br />of the water tower, that would be an <br />Cellular One is proposing. Fahey also suggested <br />that any contract contain an escalating provision. <br />Carroway stated that Cellular One would prefer the escalating provision to <br />be a five -year term provision. <br />Fahey felt that the proposal for mounting the system on water towers was <br />a creative way of lessening the impact on communities. <br />Carroway asked if for the $600 fee if Cellular One could have approval for <br />up to 9 antenna and 2 microwave dishes. <br />Council discussed this request and it was the concensus that the 6 antenna <br />proposed was the maximum for the $600 fee, however, the Council was agreeable <br />to two microwave dishes. Council indicated that in the future if additional <br />antenna were needed, Cellular One could negotiate that with the City. <br />The City Clerk reported that the City Planner has indicated that a Public <br />Hearing is necessary since a conditional use permit would need to be granted <br />to Cellular One for their proposal. <br />Carroway requested that Cellular One be able to work with the City Attorney <br />to get the necessary lease agreements drawn up prior to the Public Hearing. <br />The Council was agreeable provided that Cellular One understands that they <br />would proceed at their own risk with the understanding that Cellular One <br />would bear the cost of any attorney fees should the conditional use permit <br />be denied. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 88 -12 -530 - CALLING A PUBLIC HEARING <br />FOR JANUARY 25, 1989 ON THE REQUEST OF CELLULAR ONE <br />FOR A CONDITIONAL USE PERMIT TO INSTALL SIX - SECTOR <br />ANTENNA AND TWO MICROWAVE DISHES ON THE CITY'S WATER <br />TOWER WITH THE ANTENNA TO BE INSTALLED AT THE TOP <br />OF THE WATER TOWER, THE EQUIPMENT TO BE PAINTED TO <br />MATCH THE TOWER AND CELLULAR ONE TO REIMBURSE THE <br />CITY AT A COST OF $600 PER MONTH FOR USE OF CITY <br />PROPERTY <br />The foregoing resolution was duly seconded by Mr. LaValle. <br />Ayes (4) Fahey, LaValle, Collova, Blesener. <br />Nays (0).
