Automobile repair is not an allowed use in the B -3 <br />Zoning District, therefore, the applicant is requesting a <br />rezoning to I -1, Light Industrial which allows automobile repair <br />as a permitted use. <br />Residential Use: <br />The building previously used as a residence at this site is a <br />non - conforming use in both the I -1 and B -3 Zoning Districts. The <br />City Zoning Ordinance allows legal, non - conforming uses to <br />continue indefinitely provided the use is continued in the same <br />manner and not enlarged. However, should said use be <br />discontinued for a period of six (6) months, any future use of <br />the structure shall be made to conform with the provisions of the <br />Zoning Ordinance. , <br />Manufacturing Use: <br />As stated previously, because the manufacturing use has been <br />discontinued for six months, any future use of this structure <br />must be conforming with all provisions of the Zoning Ordinance. <br />In this case, since the property has been zoned B -3, the only way <br />this use can conform is by being rezoned I -1. <br />Lot Size: <br />The property in question is legally non - conforming due to its <br />width. The lot is approximately 71 feet wide and is substandard <br />in both the B -3 and I -1 Zoning Districts which require minimum <br />lot widths of 100 feet. The lot is long and narrow and has a <br />total area of approximately one acre, which exceeds lot size <br />requirements in both zoning districts. <br />At this time, there is no possibility of acquiring adjacent land <br />to this site due to the property owner to the north who at this <br />time has no desire to sell. That parcel is currently used as a <br />single family residence. <br />Zoning: <br />The B -3 Zoning District is intended to serve the entire community <br />and regional customer needs for commercial and service <br />activities. The property in question was rezoned from I -1 to B-3 <br />because of the visibility and accessibility due to its location <br />on Rice Street which appears to best serve the area with B -3 <br />uses. <br />Surrounding Land Use: <br />Directly north of the property in question is a lot currently <br />utilized as a single family residence and south of the site in <br />question is property abutting Rice Street that is B -3 and I -1 <br />property east of this property. <br />PAGE -36 <br />
