ISSUES AND ANALYSIS <br />All rezonings are evaluated against the criteria outlined in <br />Section 921 of the Zoning Ordinance regarding amendments of the <br />Zoning Map (rezoning). The Planning Commission and City Council <br />shall consider possible adverse affects to the proposed <br />amendment. Its judgment shall be based upon (but not limited to) <br />the following factors: <br />1. The proposed action has been considered in relation to the <br />specific policies and provisions of and has been found to be <br />consistent with the official City Comprehensive Land Use <br />Plan. <br />2. The proposed site is or will be compatible with present and <br />future land uses of the area. <br />3. The proposed use conforms with all performance standards <br />contained herein. <br />4. The proposed use will not tend to or actually depreciate the <br />area in which it is proposed. <br />5. The proposed use can be accommodated with existing public <br />services and will not overburden the City's service <br />capacity. <br />The Ordinance allows for two types of PUD's. One type is a <br />Conditional Use Permit Planned Unit Development (CUP /PUD) which <br />is utilized when there is more than one use or principal <br />structure on a site and the second type of PUD which is the <br />rezoning evaluated in this report, is a Planned Unit Development <br />Zoning District. The PUD District relies on the Comprehensive <br />Plan Land Use in order to apply and control performance standards <br />in certain areas of the City that are more sensitive in order to <br />allow uses to be more compatible with each other. <br />The zoning to PUD has been evaluated against the Little Canada <br />Comprehensive Land Use Plan which indicates that this property <br />should be used commercially. The Land Use Plan does not, <br />however, specify the type of commercial uses allowed on this <br />site. The Comprehensive Plan's proposed Zoning Map indicates <br />the Zoning District most appropriate for all property within the <br />City. The Comprehensive Plan's existing and proposed zoning map <br />clearly shows that a B -3, General Business District is the most <br />appropriate district for the properties in question. The Zoning <br />Ordinance controls the allowable uses in each Zoning District. <br />Therefore, if the property was rezoned to a PUD District, the <br />Comprehensive Plan would be used as a guideline for the district <br />and allowable uses on this property. In this case, based on the <br />current Comprehensive Plan, B -3 District uses and requirements <br />would be imposed. <br />PAGE -46- <br />
