facilities at the School, as indicated on the attached Exhibit B, <br />including necessary storm sewer facilities and appurtenances <br />thereto. Some of the public improvements will be constructed on <br />City property and some public improvements may be constructed on <br />District property. The District will provide all necessary <br />permanent easements at no cost to the City for construction of such <br />public improvements. The City will construct the public <br />improvements at its expense pursuant to Minnesota Statutes Chapter <br />429 and will assess the cost of construction of such public <br />improvements against the real property described in Exhibit A owned <br />by the District. The District agrees to execute the necessary <br />documents to stipulate as to the amount of the benefit to its <br />property and to waive any right to appeal from the special <br />assessment of the cost of the construction of said public <br />improvements. The District agrees to pay such special assessments <br />levied over a ten -year period. <br />Section 5. Use and Operation of Facilities. <br />A. The District and the City agree that the City will <br />not be charged anything by the District for the use of the <br />Gymnasium Addition. However, the City will be responsible for <br />supervision of all City- approved activities conducted in the <br />Gymnasium Addition. When the Gymnasium Addition is used for <br />meetings or other public gatherings which require the use of chairs <br />and tables, the City will also be responsible for set up and pick <br />up before and after such activities. <br />Page 4 <br />
