Uses: <br />Permitted Uses. Warehousing, light manufacturing, wholesaling, <br />and UPS /shipping are all permitted uses within the I -P District. <br />Conditional Uses. Accessory, enclosed retail and service <br />activities are allowed with a conditional use permit. Such use <br />is allowed with a CUP as long as it does not constitute more than <br />ten (10) percent of the gross floor area of the principal <br />structure (use). Specific use dimensions were not addressed on <br />the site plan so it cannot be determined if the retail area is <br />within the ten (10) percent maximum allowed. <br />Test Track. A "test track" facility is not one of the five <br />listed permitted uses under the allowable commercial recreational <br />facilities within the permitted uses section of the Ordinance. <br />Although not listed as a permitted use, the Ordinance also makes <br />no provisions for allowing other previously unlisted commercial <br />recreational facilities as conditional uses. The Ordinance is <br />vague in addressing this particular type of commercial <br />recreational use and does not provide a specific guideline for <br />application of enforcement. <br />The City may wish to consider including the "test track" facility <br />as part of the retail, service accessory use, thus limiting total <br />square footage for all accessory uses to ten (10) percent of the <br />principal use. As mentioned earlier in this report, it is not <br />possible to calculate individual use square footage amounts from <br />the site plan provided so total retail with the test track cannot <br />be calculated, however, it appears that the track and the retail <br />areas combined would exceed the ten percent allowance. <br />Another alternative would be to expand the interpretation of the <br />definition of "commercial recreational" use as a permitted use to <br />include in indoor test track. This would require Commission <br />translation of the Ordinance to allow the test track as a <br />permitted use thereby requiring a conditional use permit for the <br />retail and service activities only. All conditional uses <br />combined, whether it include the test track facility or not, <br />would still have to occupy no more than ten (10) percent of the <br />gross floor area of the principal structure, in addition the <br />accessory conditional use(s) must also conform to the <br />requirements as set forth in Sections 921.010 C and 921.030 of <br />the Ordinance. <br />Parking. Adequate off - street parking and off- street loading <br />would be required and would need to be in compliance with the <br />requirements of Sections 903.050 and 903.060 of the Ordinance. <br />Any structure containing two (2) or more types of use shall be <br />calculated separately for determining the total off - street <br />parking spaces required.
