Park Dedication. This project will be subject to park dedication <br />requirements as recommended by the Park Commission. Fees are <br />typically payable upon building permit application. <br />Development Contract. All aspects of the project will be <br />controlled by a development contract which will include the <br />various plans. <br />Subdivision. The developers are requesting subdivision approval <br />as shown on the attached Exhibits D and E. This will formally <br />split the parcels for Phase I as well as the individual lots for <br />Buildings 1 and 2. The primary issue involved in this process is <br />the provision of a full right -of -way for Nadeau Road. Currently <br />Nadeau road is constructed in a 33 foot right -of -way. Since it <br />will be serving a single family area and is not accessible from <br />the commercial property, a 50 foot right -of -way width is <br />adequate. It is our understanding that the additional 17 feet of <br />width will be taken equally from both north and south sides of <br />the current roadway. As a result, the subdivision includes the <br />dedication of 8.5 feet of right -of -way on the Phase I side. An <br />additional 8.5 feet is necessary from the Building 2 parcel which <br />is not yet controlled by the developer. The City may approve the <br />subdivision without the north side dedication, requiring the <br />additional dedication upon application for Building 2 approval. <br />Since the property is zoned PUD, any development of this land <br />will require full City review. <br />An issue which will need to be addressed upon Building 2 <br />construction is that of access to the remnant parcel along <br />Condit. This land should be accessible to Country Drive and some <br />easement agreement will be necessary upon development stage for <br />this area. <br />RECOMMENDATION <br />Based on the preceding review, our office recommends approval of <br />the Kandice Heights Commercial Park Phase I development and final <br />stage PUD plans subject to the conditions listed below: <br />1. All parking supplies are verified at project development <br />stages. <br />2. Attention is given to future phase loading areas at <br />development stage. <br />3.
