MINUTES <br />PLANNING COMMISSION <br />May 3, 1990 <br />REZONING Mrs. Susan Haram appeared before the Commission <br />HARAM requesting the rezoning of the property she and her <br />PROPERTY husband own at 2700 Rice Street from R -1 to B -3 <br />2700 RICE (General Business). Haram reported that they currently <br />have a special use permit for the property allowing its <br />use as business. Haram reported that they are <br />requesting the rezoning since they are refinancing <br />their property, and the bank has requested that zoning <br />of the property reflect its actual use. Haram reported <br />that they are not planning any change in occupancy. <br />The City Planner reviewed his report dated April 30, <br />1990 wherein he recommends that the property be rezoned <br />to B -1, Limited Business District, which he believes is <br />more in keeping with the Comprehensive Plan policy and <br />restricts active retail use of the site. The Planner <br />noted that this would resolve the refinancing problem <br />since office use of the property would be allowed by <br />conditional use permit. <br />DeLonais was of the opinion that the R -1 zoning of the <br />property should remain. DeLonais pointed out that Iona <br />Lane residents have fought so that control is <br />maintained over the property. DeLonais felt a rezoning <br />to Business could have an adverse effect on the <br />adjacent residential area. DeLonais stated that he <br />would like to see the City maintain control over the <br />two lots at the corner of Rice Street and Iona Lane. <br />Costa felt the property should be rezoned to Business, <br />pointing out the difficult position the property owners <br />are in if they own a piece of property but the bank <br />will not give them a loan on it because of the zoning. <br />Costa pointed out that Rice Street is a business <br />street, and felt the property should be zoned as such. <br />Costa questioned how much the City must do to protect <br />Iona Lane. <br />Tim Townsley, Iona Lane resident, pointed out that Iona <br />Lane is an R -1 area and pointed out that his property <br />is becoming encircled by commercial business. Townsley <br />stated that the Haram property has been used as an <br />office for a long time, and he did not want the zoning <br />changed so that something worse could come in. <br />Townsley stated that he could foresee where B -3 zoning <br />would be a problem. Townsley did not want to have a <br />convenience store locate on the site pointing out that <br />he has had nothing but problems with the shopping <br />center that is in his backyard. Townsley stated that <br />he preferred the special use permit situation. <br />Page 7 <br />
