MINUTES <br />PLANNING COMMISSION <br />May 3, 1990 <br />Costa pointed out that Rice Street was a high traffic <br />area. <br />Townsley agreed with DeLonais that the City should <br />retain control over the property. <br />Drabik asked if the City could rezone the property but <br />still maintain some control. <br />The City Planner replied that this is why he <br />recommended B -1 zoning so that the City has conditional <br />use control. Under B -3 zoning any commercial use <br />allowed in the City would be a permitted use. B -1 <br />zoning limits the property to neighborhood business <br />uses, and the Planner went on to read those uses from <br />the ordinance. <br />Mrs. Haram asked what is allowed with B -1 zoning that <br />is not allowed now. <br />The City Planner pointed out that under the R -1 zoning, <br />if the structure burned down, the building could not be <br />re- established as a business without coming back to the <br />City Council for approval. Under B -1 the business <br />could be re- established if it was done within a certain <br />amount of time. <br />Mr. Haram reported that the warranty deeds for the Iona <br />Lane properties state that these properties are to be <br />protected for 20 years, and that 20 years expired in <br />1985. <br />DeLonais asked Haram if he could obtain a copy of that <br />covenant. <br />Costa pointed out that there are uses on Iona Lane that <br />should not be there such as a dump truck at one of the <br />homes and an upholstery business in the basement of <br />another. <br />Tim Townsley stated that he is not conducting an <br />upholstery business from his home. He reported that he <br />has an upholstery repair service and he goes out and <br />makes repairs in other people's homes. Townsley also <br />pointed that he maintains his property, and indicated <br />some complaints he had about the Haram property. <br />Mr. Haram stated that he knows for a fact that Townsley <br />has done reupholstery work in his basement. <br />Page 8 <br />
