Operational Requirements. As a provision of acceptance, a number <br />of operational requirements have been imposed upon convenience <br />gas facilities such as proposed (Section 912.040.C). <br />1. The sale of retail goods involves uses or activities which <br />are allowed in a "B -1" or "B -2" district. <br />2. Convenience /deli food is of the take -out type only and that <br />no provision for seating or consumption on the premises is <br />provided. Furthermore, that the enclosed area devoted to <br />such activity, use and merchandise shall not exceed fifteen <br />(15) percent of the gross floor area. <br />3. That any sale of food items is subject to the approval of <br />the Ramsey County Health Department who shall provide <br />specific written sanitary requirements on an individual <br />basis for each proposed sale location. <br />4. That the non - automotive sales shall qualify for and be <br />granted on annual food handling, retail sales license or <br />other license, as circumstances shall require, in addition <br />to the permit for a conditional use under the Zoning Code. <br />5. That the area and location including exterior, outside space <br />devoted to non - automobile merchandise sales shall be <br />specified and any expansion of the space or change in <br />location without an amendment to the permit shall constitute <br />grounds for revocation of the permit, after a hearing before <br />the City Council. <br />6. The hours of operation shall be limited to six (6) o'clock <br />a.m. to twelve (12) o'clock p.m., unless extended by the <br />City Council. <br />Fuel Tank Relocation. As shown on the submitted site plan, the <br />site's existing fuel tanks located in the southeastern corner of <br />the site are to be relocated and placed perpendicular to the <br />Woodlynn Avenue right -of -way on the site's southern border. The <br />relocation of the tanks follows the intention of the <br />applicant(s) to locate the car wash facility upon the fuel tanks' <br />current location. The relocation of the tanks is not considered <br />a problem in that it will allow a more efficient use of the <br />site. This issue should, however, be subject to the review and <br />comment of the City Engineer. <br />Landscaping. Prior to final site plan approval, the applicant <br />must submit a landscape plan. The plan should designate the <br />location, size and type of all plantings which are to occur upon <br />the subject site. While not specifically required by ordinance, <br />it is recommended that vehicular parking areas be screened from <br />public right -of -way. <br />4 <br />Page 61 <br />
