MINUTES PLANNING COMMISSION JANUARY 11, 1990 The City Planner replied that decks are allowed to encroach into the rear yard setback. Drabik recommended that the Valento front yard setback variance request be denied since there is no hardship present to warrant granting the variance request. Motion seconded by Bendel. Motion defeated 3 to 3. Drabik, Bendel, Pedersen voting in favor and Costa, DeLonais, Herkenhoff voting against. DeLonais recommended approval of a variance for a 31 foot front yard setback for Lots 2, 3, and 4, Block 3, Thunder Bay Estates 2nd Addition from the curbline, which would be comprise of 6 feet from the curbline to the right -of -way line and a 25 foot front yard setback form the right -of -way line to the proposed homes. Motion seconded Motion defeated voting in favor against. by Costa. 3 to 3. DeLonais, Costa, Herkenhoff and, Drabik, Bendel, Pedersen voting The City Planner suggested that the Planning Commission could pass on the request to the Council without a recommendation, and suggested that to do so a motion should be passed stating that the Commission cannot reach a concensus on this request. Herkenhoff suggested that the matter be tabled until Valento can appear and given the Commission some additional reasons supporting his request. The City Planner did not think Mr. Valento's appearing at the meeting would produce any additional facts. DeLonais recommended that the Valento variance request be passed on to the City Council without a recommendation. That motion died for lack of a second. Bendel recommended that the Valento variance request be denied as presented, but indicating that the Planning Commission is recommending that a compromise be considered by the City Council. Page 6
