including but not limited to consideration of age of the <br />structure, damage or destruction of all or part of the Tower or <br />the Property from any source, or factors relating to condition <br />of the Property; or (d) by Landlord if Tenant's use of the <br />Property becomes illegal under any federal, state or local law, <br />rule or regulation. <br />Upon termination of this Lease for any reason, Tenant shall <br />remove its equipment, personal property, Antenna Facilities and <br />leasehold improvements from the Tower and the Property within <br />sixty (60) days after the date of termination, and shall restore <br />the Tower and the Property to the condition it was in on the <br />Commencement Date of the term of this Lease, all at Tenant's <br />sole cost and expense. <br />8. Indemnification. Tenant agrees to indemnify, defend, <br />and hold harmless Landlord and its elected officials, officers, <br />employees, agents, and representatives, from and against any and <br />all claims, costs, losses, expenses, demands, actions, or causes <br />of action, including reasonable attorneys' fees and other costs <br />and expenses of litigation, which may be asserted against or <br />incurred by the Landlord or for which the Landlord may be held <br />liable, which arise from any act or other fault of Tenant or its <br />employees, agents, or subcontractors in the performance of this <br />Lease or from the installation, operation, use, maintenance, <br />repair, removal, or presence of Tenant's transmission facilities <br />on the Property and the Tower, and specifically including the <br />representations and warranties of Paragraph 10(b) of this <br />Lease. Nothing in this Agreement shall constitute a waiver by <br />the County of any statutory limits or exceptions on liability. <br />9. Notices.
