Hanson, City Administrator <br />RE: Water & Sewer Main Issue <br />CITY OF LITTLE CANADA <br />RAMSEY COUNTY, MINNESOTA <br />MAYOR <br />Michael Fahey <br />COUNCIL <br />Beverly Scalze <br />Bill Blesener <br />Rick Collova <br />Jim LaValle <br />Attached is a letter I sent to Tom Short regarding the existing <br />private water and sewer mains between Graebel Movers and Market <br />Place. (See Map Attached) Also enclosed is a letter from Mover's <br />Warehouse, Inc. asking for city action to address this matter. <br />My recommendation is that the City attempt to acquire easements for <br />the water and sewer mains based on the following factors: <br />1. Watermain loops around Market Place property from Rice Street <br />to First Bank Drive. As a private system, the City cannot <br />regulate its usage without affecting other properties. (The loop <br />may also include stretch from First Bank Dr. to Little Canada Rd. <br />2. Also based on the same condition as #1, if a main break were to <br />occur or other maintenance needed, the City does not have any <br />legal right to address these problems. <br />3. Because of the direct, looped connection to the City system, <br />on -going maintenance should be performed on the watermain. <br />4. Water usage off this portion of the system is non - metered <br />(i.e. hydrant flushing, leakeage, etc.). <br />5. The sewer main easement I would propose the City acquire would be <br />for the 225 feet running west from the railroad track main. <br />The balance should remain private. <br />6. Appropriate testing and inspection should be done before <br />acceptance. <br />7. I would assume the easements would be acquired at no cost to the <br />City. This is based on the assumption that the owners may want <br />to avoid liability associated with costly repairs and on <br />prescriptive use factors. (Prescriptive use should be addressed <br />by the City Attorney.) <br />I have reviewed this situation briefly with Dave Harris, Public Works <br />Superintendent, and Don Carley. Both agree we should pursue this <br />matter as discussed in my letter to Mr. Short. I also recommend the <br />involvement of the City Attorney in this process should the Council <br />decide to proceed. <br />Pa.gt2A2 <br />
