MINUTES <br />PLANNING COMMISSION <br />OCTOBER 11, 1990 <br />The City Planner felt this instance was difference <br />since the City is dealing with an established, paved <br />surface. <br />The City Planner reviewed his report dated October 9, <br />1990 in which he sites both the Liebel and Stewart <br />applications which he felt were not entirely similar to <br />the current proposal. <br />Bendel asked what liability the City would incur by <br />allowing another resident to utilize a private road for <br />public access. <br />The City Planner replied that he would want the City <br />Attorney to review the situation to ensure that the <br />City has adequate easement to use the driveway for <br />public safety reasons. <br />The Planner pointed out that the situation is a <br />subdivision with a private road that was approved some <br />time ago. The question is whether or not the City is <br />going to allow a new lot to be established on an <br />existing private road versus a situation where the City <br />is asked to approve a new private road. <br />John Grabick, 2354 Greenbrier Circle, asked how many <br />additional lots could be proposed along this private <br />road. <br />Remi Ducharme replied that there are currently 3 homes <br />on the private road, and the lot being proposed by Mr. <br />Murphy would be the last one. There would be no room <br />for additional lots. <br />Grabick asked if there were sanitary sewer to the area. <br />Ducharme replied that there was and described its <br />location. <br />Grabick stated that he did not object to the request. <br />Mark Kolb, 2388 Greenbrier Circle, asked if the road <br />would ever be widened. <br />Ducharme replied that there would be no room to widen <br />the road unless retaining walls are installed. <br />Murphy reported that he has a letter from Mr. Tom Reid <br />who has indicated that he does not oppose the proposal. <br />Herkenhoff recommended approval of the lot split and <br />variance from the Code requirement of frontage on an <br />Page 9 <br />
