It should be noted that existing structures are located on Lots 2 <br />and 3. The home is to remain on Lot 2 while the structure on Lot <br />3 will be replaced by a new single family home. The existing <br />structures will meet setbacks after the parcel is subdivided. <br />Setbacks. Setbacks for the R -1 zone are as follows: <br />Front Yard: <br />Side Yard: <br />Rear Yard: <br />Not less than 30 feet <br />Not less than 10 feet <br />Not less than 30 feet <br />The existing structures on the parcel will meet all required <br />setbacks after subdivision. <br />Easements. The Subdivision Ordinance requires easements for <br />utilities of at least six (6) feet in width to be provided along <br />all lot lines. The preliminary plat illustrates these easements <br />on the inset map typical example. All easements, however, shall <br />be subject to the review of the City Engineer. <br />Lot Access. Lot access will be via an extension of Sunrise Drive <br />ending in a cul -de -sac. The Subdivision Ordinance requires that <br />cul -de -sacs be •no longer than 500 feet in length. The proposed <br />Sunrise Drive cul -de -sac measures approximately 650 feet. A <br />variance from the 500 foot length, must therefore be applied for. <br />The variance request must satisfy the conditions governing <br />consideration of variance requests: <br />a. That there are special and highly unique circumstances or <br />conditions affecting said property which are not common to <br />other properties in the City and that the strict application <br />of the provisions of this Ordinance would deprive the <br />applicant of the reasonable and minimum use of his land. <br />b. That the granting of the variance will not be detrimental to <br />the public health, welfare or injurious to other property in <br />the territory in which property is•situation. <br />c. That the variance is to correct inequities resulting from an <br />extreme hardship limited to topography, soils or other <br />physical factors of the land. <br />Sunrise Drive was originally platted through to the north edge of <br />the property. The proposed addition is a logical extension of <br />this - right -of -way to serve these new lots. Severe topographic <br />conditions exist surrounding this subdivision as the land drops <br />off in steep elevations on all sides making it nearly impossible <br />to access this site from any other direction.
