MINUTES <br />PLANNING COMMISSION <br />NOVEMBER 8, 1990 <br />Motion seconded by Pedersen. <br />Motion carried 5 - 0. <br />TACHENY Mr. Daniel Tacheny appeared before the Commission <br />LOT SPLIT requesting approval of a lot split and variance from <br />& VARIANCE the Code requirement of 30 foot rear yard setback for <br />his property located at 623 LaBore Road. Mr. Tacheny <br />reported that he purchased the property in 1989. <br />Tacheny explained that he would like to make some <br />improvements to the existing home. In order to do so, <br />he would like to divide his property into two lots and <br />sell the lot that would front on LaBore Road. The <br />existing house would then front on Payne Avenue. <br />Tacheny reported that he would be purchasing a strip of <br />property from his neighbor, which he is proposing to <br />combine with this property. This will give him the <br />required 75 feet of frontage on Payne Avenue. <br />The City Planner explained that the variance that is <br />needed is technical in nature, since as a result of the <br />property division proposed, the front yard of the <br />Tacheny property would become Payne Avenue, thus the <br />existing side yard becomes the rear yard. <br />DeLonais pointed out that as a result of the variance <br />being approved, the property would become <br />non - conforming. <br />The Planner replied that this was true, but pointed out <br />that if the existing home were damaged, the property <br />owner would have six months to re- establish the use of <br />the property. <br />Pedersen pointed out that the only thing that is <br />changing is the additional lot, the location of the <br />existing house is not changing. Pedersen stated that <br />he understands that the variance request does not meet <br />the technical guidelines to warrant approval, however, <br />Pedersen stated that it did not make sense not to <br />approve the request. <br />Garske asked if a precedent would be set if the <br />variance were approved. <br />Page 2 <br />
