MINUTES <br />PLANNING COMMISSION <br />NOVEMBER 8, 1990 <br />The Planner replied that the variance request does not <br />meet City guidelines, therefore, if approved, the City <br />must be willing to grant similar requests. <br />Drabik pointed out that there are a lot of large lots <br />in the City and felt that if this variance request were <br />approved, the City would be faced with similar requests <br />in the future. Drabik felt that approval of the <br />request should include a statement as to why the <br />variance is being approved. <br />Pedersen pointed out that Payne Avenue did not exist <br />when the Tacheny home was constructed. <br />The Planner replied that this is true, however, Payne <br />Avenue was a platted street at the time. <br />Jean Smith, property owner in the area, pointed out <br />that all the homes along LaBore Road in this area are <br />on large lots and have large setbacks from the street. <br />Smith asked if City Code required front yard setbacks <br />to be in conformance with the majority of those along <br />the street. Smith was concerned that if the property <br />division were approved, a home would be constructed <br />with a smaller front yard setback than her's, and felt <br />this would decrease her property value as well as <br />reduce her privacy. <br />The Planner replied that the Code requires a 30 foot <br />front yard setback from the right -of -way line. The <br />City has approximately 15 feet of right -of -way from the <br />curb line of LaBore Road, therefore, a home constructed <br />on the newly created lot would have a minimum front <br />yard setback of 45 feet from the curb. <br />Drabik asked if the City could stipulate a larger front <br />yard setback for the proposed lot. <br />The City Planner thought a larger front yard setback <br />would make the lot unbuildable, since most of the <br />buildable area is in the front. <br />Tacheny pointed out that there is a row of mature pine <br />trees between his property and Smith's, therefore, a <br />new home would be screened from the Smith property. <br />DeLonais pointed out that there is no hardship present <br />to warrant granting the variance. <br />Tacheny asked for an explanation of hardship. <br />The City Planner replied that a hardship cannot be <br />Page 3 <br />
