MINUTES <br />PLANNING COMMISSION <br />NOVEMBER 8, 1990 <br />economic in nature, but rather due to the physical <br />characteristics of the property. <br />A resident of the area asked if the City could place <br />restrictions on the type of house that could be <br />developed on the lot if the property division is <br />approved. <br />Pedersen replied that the City would only require that <br />the house meet Code requirements. <br />A resident asked if the City had a height restriction <br />for single - family homes. <br />The City Planner estimated the height restriction for <br />single - family homes at 2 1/2 stories, or 25 feet. <br />Pedersen recommended denial of the property division <br />and variance from the Code requirement of 30 feet rear <br />yard setback as requested by Mr. Daniel Tacheny, 623 <br />LaBore Road since the variance request does not meet <br />City guidelines of hardship based on the recommendation <br />of the City Planner as contained in his report dated <br />November 1, 1990. <br />Motion seconded by Drabik. <br />Motion carried with Pedersen, Drabik and DeLonais <br />voting in favor, Bendel voting against, and Garske <br />abstaining. <br />BRAUSEN Mr. Ted Brausen appeared before the Commission <br />LOT SPLIT requesting approval of the division of the property <br />& CUP FOR located at 2822 Rice Street as well as a conditional <br />SHARED use permit for shared parking. Brausen reported that <br />PARKING he is proposing to redevelop the property at 2822 Rice <br />Street with a gas station, car wash and convenience <br />store. <br />The City Planner reported that the request before the <br />Commission is to divide the property as well as <br />approval of off -site parking. The applicant will have <br />to resubmit applications for conditional use permit for <br />gas station and convenience store in the future. The <br />Planner recommended approval of the request contingent <br />upon the future conditional use permit application. <br />DeLonais asked if there would be enough parking <br />remaining for the adjacent shoe store and barber shop. <br />The City Planner replied that it appears there would <br />Page 4 <br />
