MINUTES <br />PLANNING COMMISSION <br />JULY 12, 1990 <br />Bendel pointed out that the applicant cannot assume the <br />City's legal liability that would be imposed by <br />approving a driveway over a public right -of -way. <br />Bendel asked if the City was prepared to accept this <br />exposure. <br />Pedersen pointed out that the liability situation <br />already exists given the driveway for 298 Rose Place. <br />The Commission questioned access to the property by <br />emergency vehicles. <br />Bob DeBace stated that he did not believe there would <br />be a problem for access by fire trucks, unless the <br />driveway was muddy, also pointing out that he could not <br />predict storms that might occur. DeBace suggested that <br />perhaps a blacktop mat could be installed to provide <br />access, rather than requiring a cul -de -sac with curb <br />and gutter and storm sewer. <br />The Planner agreed that this would improve the <br />situation from a gravel road. The Planner also noted <br />that the City has allowed some smaller than standard <br />cul -de -sacs in other situations. <br />Costa suggested a dead -end street rather than a <br />cul -de -sac. <br />The Planner pointed out that it is public right -of -way <br />and the need for a turn - around so that drivers would <br />not encroach on the Stewart property. <br />Costa did not believe two lots could afford a <br />cul -de -sac. <br />Herkenhoff recommended approval of the division of the <br />Stewart property at 314 Rose Place into two lots as <br />requested by Mr. Thomas Stewart. <br />Motion seconded by Costa. <br />Motion carried 7 - 0. <br />Costa asked if Stewart could afford the assessments for <br />an improved street. <br />Stewart replied that he is very interested in building <br />a home on the property, and if an improved street is <br />what it takes, he would have to look at the costs. <br />Stewart asked if he and Buche could contract for the <br />Page 5 <br />
