MINUTES <br />PLANNING COMMISSION <br />JULY 12, 1990 <br />blacktopping themselves. <br />The Planner pointed out that the work would have to <br />have the approval of the City Engineer, and if the <br />property owners did the work themselves, the costs <br />could not be assessed. <br />Drabik suggested that the applicant work with the City <br />Engineer to develop an acceptable access plan. <br />Herkenhoff stated that he was not opposed to a class V <br />driveway if that will do the job, but would support a <br />blacktop driveway if the applicant can afford it. <br />Bendel pointed out that by allowing a surface that does <br />not meet the City's minimal standards, the City is <br />assuming liability. The applicant cannot assume the <br />City's liability on street right -of -way. Bendel felt <br />that the situation needed to be acceptable to the City <br />Attorney as well as City Engineer. Bendel stated that, <br />hopefully, something less than a full -blown street <br />could be agreed to. <br />Herkenhoff stated that he was more concerned about what <br />the applicant and City Engineer could work out. <br />Herkenhoff was concerned that the City Attorney will <br />want a full road improvement which would be a financial <br />hardship to two property owners. <br />Mike Ritchie suggested that the lot split could be <br />approved contingent upon the Mr. Stewart, Mr. Buche, <br />the City Attorney and City Engineer working out a <br />satisfactory solution for access, as well as the <br />details as to how much the improvement will cost and <br />who will pay for it. <br />Stewart asked if the City would maintain the access. <br />The Planner replied that it would be maintained by the <br />City if the access met City standards. <br />Herkenhoff recommended approval of the Stewart variance <br />request from the requirement of road frontage on an <br />improved public street, with a strong recommendation <br />that some type of blacktop mat be installed to provide <br />access that would not be as costly as a full road <br />improvement that would include curb and gutter and a <br />cul -de -sac, the details of which would be worked out <br />with the City Engineer. <br />Motion seconded by Garske. <br />Page 6 <br />
