TO: Business Owner and /or Manager <br />From: Ramsey County Sheriff's Office <br />Date: August 15, 1990 <br />Re: Change in policy regarding NSF /NO ACCOUNT checks. <br />Certainly, you are aware of the increase in the amount of <br />worthless and forged checks. Worthless checks are any non - <br />sufficient (NSF) , or account closed checks that may have <br />been returned to you. Prosecution has become an almost <br />impossible task due to so many points of law, suspect <br />identification and privacy act problems. <br />We regret that time and resources will not allow us to <br />investigate worthless checks under $50.00 or held longer <br />than 30 days after acceptance, before reporting it to our <br />office. This change is consistent with many of the <br />surrounding municipal police departments that long ago <br />enacted such policies. <br />In addition to the above changes, we have also enacted <br />other minimun criteria for legal and prosecution reasons <br />which must be met on "NSF /NO ACCOUNT" checks meeting the <br />above minimum requirements for reporting. If any of these <br />are found lacking, the result will be non - acceptance of <br />your complaint and delayed prosecution until such time the <br />requested information is provided. This includes: <br />1. At the time of the report, you must have a copy of your <br />demand for payment form and a U.S. Mail return receipt or <br />affadavit, indicating a 5 business day waiting period from <br />service of demand date and the police report date. <br />2. You must have evidence of a photo I.D. being used as <br />identification while passing the check, with any Driver's <br />license numbers or vehicle license numbers indicated on the <br />check and verified by whoever accepted the check. If this <br />is not present, the clerk must make positive Identification <br />of the passer from memory. <br />3. You must have identification of who accepted the check <br />and their initials indicated on the check at the time of <br />passing. <br />Page 35 <br />
