Deputies have also been instructed not to take reports
under the following special circumstances:
1. If you accepted partial payment of old or bad debts.
2. If you sent the check to a collection agency prior to
reporting it to the Sheriff's Office. This can be done
after the check has been reported to us.
3. If the check comes back "STOPPED PAYMENT ", and the
facts established by the deputy indicate a dispute
regarding the service or item purchased or contract
disputes, This is a civil matter that can be remedied via
Conciliation Court or Collection Agencies. If criminal
intent can be established, the deputy will take a report.
4. If the Checks were received by mail or that were placed
in a drop box.
5. If the checks are Rent /Security Deposit checks.
6. If the checks are drawn on a out -of -state bank.
7. If the check is post dated.
Obviously, you must provide the Deputy with the original
check at reporting time. This will be returned to you at a
later date for your civil proceedings.
On those checks which you accept that are returned as
NSF /NO ACCOUNT and are less than $50.00 or older than 30
days, we suggest you use Collection Agencies or
Conciliation Court to recoup your loss.
We will continue to investigate any forgery, no matter what
the dollar amount.
Please advise you staff of these changes that will be
effective August 15, 1990. If you have any questions
regarding this or any other areas, please contact me.
Sincerely,
Charles L. Zacharias
By: Lt. Daniel J. Votel
Commander - Investigative Unit
Ramsey County Sheriff's Office
Page 36
