MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 13, 1990 <br />DeBace replied that the length of the cul -de -sac would <br />exceed what the Code allows. <br />Clarence Bruehn asked if anyone had approached the <br />property owners on the south to see if they have <br />changed their minds about Costa Lane extending through <br />to LaBore Road. <br />DeBace replied that to his knowledge, the residents on <br />the south have not changed their position opposing the <br />extension through to LaBore Road. <br />Ron Tunehorst, owner of Lot 13 on Vanderbie, reported <br />that he purchased his property 22 years ago because the <br />lot was large and he wanted the open space. Tunehorst <br />reported that at that time he had no intention of ever <br />dividing his property, and still has no intention of <br />dividing. Tunehorst asked if Costa Lane is approved as <br />proposed, if he property would be assessed for the <br />improvement. <br />DeBace replied that the right -of -way for Costa Lane <br />would be entirely on the Costa property. Any <br />assessment for the road improvement would be borne by <br />the Costa family, unless some time in the future Mr. <br />Tunehorst would divide his property. At that time he <br />would be required to pick up his fair share of the <br />assessment, although DeBace stated that he did not know <br />the details of how this would work. <br />Tunehorst asked if the Costa family would pay for the <br />sewer, water and road improvement needed for Costa <br />Lane. <br />DeBace replied that this was correct. <br />Herkenhoff asked if the improvement would effect <br />Tunehorst's property taxes. <br />DeBace did not believe it would. <br />Vernon Peterson, owner of Lot 15 on Vanderbie, stated <br />that the major concern of the property owners is <br />whether Lots 12 and 13 would be assessed for the <br />improvement since these two lots border on proposed <br />Costa Lane. Peterson asked if it were correct that <br />these lots would not be assessed unless these <br />properties are divided. <br />DeBace replied that this was correct. <br />Page 3 <br />
