3. Compliance with Laws and Regulations. The Developers <br />represent to the City that to the best of their knowledge the <br />extension of the water main will comply with all city, county, <br />metropolitan, state and federal laws and regulations, including, <br />but not limited to, subdivision ordinances, zoning ordinances <br />and environmental regulations. Developers shall obtain all <br />necessary permits and consents for the project, including but <br />not limited to the permit required from the Minnesota Department <br />of Transportation due to the proximity of the construction to <br />Trunk Highway 36, and the permit required from the Minnesota <br />Department of Health due to the watermain extension. The <br />Developers shall reimburse the City for any costs or expenses <br />incurred by the City due to the need for any permits or <br />consents, and shall post any bond required by the State at their <br />own expense. <br />4. Development Exhibits. The Developers shall construct <br />the proposed water main in accordance with Exhibit A, attached <br />hereto, and on file in the offices of the City. <br />5. Required Improvements. The Developers shall install, <br />at their own expense, the extension of water main. The City <br />Engineer shall design the water main extension in accordance <br />with City specifications. The City must approve the contractor <br />who will install the water main extension. The City Engineer <br />shall inspect the construction of the improvement, and upon <br />satisfactory completion of the construction, he shall certify <br />-2- <br />Page 109 <br />
