MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 12, <br />ZONING TEXT <br />AMENDMENT <br />AUTO REPAIR <br />1991 <br />Mr. Duane Meron appeared before the Commission <br />requesting approval of a Zoning Text Amendment which <br />would allow auto repair in the Industrial Park <br />District. It was noted that the property in question <br />is located at 2884 Centerville Road. The building at <br />this location consists of 5,200 square feet, and 2,000 <br />square feet are being used for auto repair. Previously <br />the property had been used for truck repair. In 1985 <br />the Zoning was changed from I -1 to I -P making the truck <br />repair business a non - conforming use. <br />The operator of the auto repair business reported that <br />all of their work is conducted indoors. Also, the <br />business faces to the east, therefore, is not visible <br />from the road. There is only a standard business sign <br />at the road that indicates the location of the <br />business. The operator also reported that overhauling <br />of engines and transmissions is not done at the site, <br />but sent out to other businesses. <br />The City Planner reported that the business is <br />considered major auto repair, which is not a permitted <br />use in the I -P District. <br />It was pointed out that there was major truck repair <br />business at the site until the middle of December. <br />Pedersen asked about the Stenger auto repair business. <br />The City Planner reported that the Stenger business was <br />in existence at the time the Ordinance was changed, <br />therefore, that business is legally non - conforming <br />under the Ordinance. <br />Pedersen asked why the truck repair was allowed to <br />operate, and why the non - conformity is not being <br />allowed to continue. <br />The City Planner reported that in Staff's review of the <br />Ordinance, truck repair and auto repair are two <br />separate uses, therefore, the non - conformity does not <br />continue to be grandfathered in. <br />Meron stated that it was his understanding that as long <br />as there is not a 6 -month lapse in operation of a <br />business, the non - conformity would continue to be <br />grandfathered in. <br />Page 2 <br />
