MINUTES <br />PLANNING COMMISSION <br />AUGUST 8, 1991 <br />The Planner stated that his concern was that displays <br />will dominate the fronts of buildings as well as <br />sidewalk areas. The Planner reported that gas <br />stations /convenience stores are only permitted by CUP, <br />therefore the issue of outdoor sales /displays can he <br />included initially. However, new Conditional Use <br />Permits would be required of existing gas <br />stations /convenience stores. The Planner felt the CUP <br />process would give the City some control. <br />Drabik asked about enforcement, and suggested there may <br />be the need to add part -time enforcement help during' <br />the summer months. <br />The City Planner reported that when a problem surfaces <br />at City Hall, the City follows up on enforcement. <br />Drabik asked about the need for a permit for sidewalk <br />sales. <br />The City Planner reported that he is suggesting that. <br />the City's ordinance be amended to exempt <br />festival - related activities from the need for a <br />Conditional Use Permit. Under current Code provisions, <br />a CUP would be needed for events such as Canadian Days, <br />flea markets, etc. <br />DeLonais again stated that it was his feeling that no <br />more regulations should be placed on businesses and <br />felt outside display of merchandise related to <br />business should be a permitted use. However, DeLonais <br />was opposed to outdoor sales by vendors not related to <br />the business of such items as garden goods, pictures, <br />etc. <br />Bendel disagreed, pointing out that the City goes to <br />great lengths in trying to keep up the appearance of <br />the community. Bendel felt that the City needed the <br />ability to control outdoor sales. <br />DeLonais pointed out that the City has not had a <br />problem so far, and stated that the City cannot <br />enforces the ordinances that it has. <br />Bendel felt the issue should not be confused with poor <br />enforcement. Bendel stated that no one disagrees that <br />local businesses need support, however, at the same <br />time there is the issue of what is appropriate <br />advertisement. <br />The City Planner reported that the only change that he <br />is recommending to the existing Ordinance is that the <br />City set up a licensing procedure for civic <br />festival- related activities. <br />Page 9 <br />
