MINUTES <br />PLANNING COMMISSION <br />JANUARY 10, 1991 <br />DeLonais also pointed out that once these walkways are <br />developed, the City is responsible for the maintenance <br />of them, pointing out the large amount of park land the <br />City is already responsible to maintain. <br />DeBace reported that he has looked at these paths in <br />Little Canada and Maplewood and his personal opinion is <br />that they are terrible. DeBace reported that there is <br />one path in Little Canada that is only about 8 feet <br />from the adjacent house, and DeBace felt this was a <br />major loss of privacy. <br />Pedersen pointed out that at a recent meeting, the <br />Council reconsidered its position and recommended in <br />favor of walkways within the Costa Estates plat. <br />Pedersen pointed out that there is a walkway in his <br />neighborhood, and without it he would not have access <br />to nearby park land. Pedersen felt the best time to <br />put in the paths was at the time the plat is developed. <br />Drabik reported that there are no walkways in her <br />neighborhood, therefore, there is no ready access to <br />nearby park land. It was pointed out that without the <br />paths, trespassing problems occur. <br />DeLonais asked if the City purchased the property <br />necessary for these walking paths. <br />The City Planner reported that typically the City <br />requires 6 foot drainage and utility easements along <br />property lines, and if paths are determined necessary, <br />the easements can be expanded to include the walking <br />path as well. The Planner pointed out that the City is <br />legally entitled to require these paths. <br />Pedersen pointed out that on November 28th the City <br />Council reaffirmed its position that Costa Lane should <br />go north to Allen Avenue. Pedersen asked where the <br />City stood with the issue of obtaining the road <br />right -of -way necessary to the north. <br />The City Planner agreed that the last approval involved <br />Costa Lane going north to Allen Avenue. However, due <br />to the developer indicating that the cost of going <br />north would be too expensive and time - consuming, a <br />revised preliminary plat is now before the Commission. <br />DeBace reported that he has estimated the cost of going <br />north to Allen Avenue with Costa Lane would be $55,000 <br />without paying for the road improvement. This figure <br />includes cost of condemnation, legal fees, cost of <br />right -of -way, and assessment costs. <br />Page 3 <br />
