MINUTES <br />CITY COUNCIL <br />JULY 24, 2013 <br />LITTLE <br />CANADA <br />ROAD <br />IMPROVEMENT <br />CUP - <br />3176 RYAN <br />LANE — <br />FISCHER <br />Blesener reported that there is an error in the latest City newsletter <br />issue. The article headline indicates that the Little Canada Road project <br />from I35E to Edgerton Street will not begin until 2014. Blesener <br />reported that the project will begin in 2013. The decision to proceed with <br />the project this year was made at the July 10'" meeting based on input <br />received from the contractor. <br />Mayor Blesener opened the Public Hearing to consider application for <br />Conditional Use Permits allowing two Major & Minor Auto Repair Uses <br />at 3176 Ryan Lane as requested by Russ Fischer. It was noted that the <br />Code Enforcement Officer and the Planning Commission recommended <br />approval of the Conditional Use Permits subject compliance with the <br />recommendations of the Code Enforcement Officer as outlined in her July <br />9, 2013 report and subject to verification that parking meets Code <br />requirements. <br />The City Planner reported that Russ Fischer has applied for CUPs for two <br />auto repair major and minor licenses. One such license is currently active <br />for this property and Mr. Fischer will be renting to a new tenant seeking a <br />second auto repair major and minor licenses. The Planner reported that <br />given the applicant has proposed some changes to the site plan, the CUPs <br />for both businesses have come up for review. <br />The City Planner reported that the Code Enforcement Officer has <br />reviewed the application and outlined recommendations for approval as <br />outlined in her July 9, 2013 report. He noted that one open issue was <br />whether or not there was adequate on -site parking. The Code requires 17 <br />parking spaces for this property based on its use. The Planner indicated <br />that he visited the site and it appears the property can easily comply with <br />this Code requirement. A new site plan has been submitted showing <br />compliance. The Planner pointed out that the 17 parking spaces can be <br />used for employee and customer parking. Material storage is not allowed <br />within the required parking. The Planner also noted that the Fire Marshal <br />has inspected the property and finds compliance with the Fire Code. <br />Blesener asked if Fischer already had a second auto repair tenant. Fischer <br />replied that he did. The tenant is waiting for approvals before moving into <br />the property. <br />Montour asked about screening. Fischer indicated that the appropriate <br />screening is already in place. <br />2 <br />
