MINUTES
CITY COUNCIL
JULY 24, 2013
There was no one else from the general public present wishing to
comment on this matter.
Upon motion by Montour, seconded by Keis, the public hearing was
closed.
McGraw introduced the following resolution and moved its adoption:
RESOLUTION NO. 2013 -7- 129 — APPROVING CONDITIONAL USE
PERMITS ALLOWING TWO (2) MAJOR & MINOR AUTO REPAIR
LICENSES AT 3176 RYAN LANE REQUESTED BY R USS FISCHER
SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS
OF THE CITY PLANNER AND THE CODE ENFORCEMENT
OFFICER
The foregoing resolution was duly seconded by Keis.
Ayes (5).
Nays (0). Resolution declared adopted.
CUP & IUP — Blesener opened the Public Hearing to consider application for a
3177 SPRUCE Conditional Use Permit for outdoor storage and Interim Use Permit
STREET — allowing outdoor storage for off-site tenant at 3177 Spruce Street
KREBSBACH requested by John Krebsbach. It was noted that the City Planner and the
Planning Commission recommended approval subject to compliance with
the recommendations of the City Planner as outlined in his July 5, 2013
report and subject to submittal of a satisfactory site plan.
The City Planner noted that the applicant is requesting a CUP for outdoor
storage as well as an IUP to lease outdoor storage space to a Little Canada
business located across the street. The proposed IUP storage area consists
of approximately 5,000 square feet and is located in the southwest corner
of the property. The remainder of the outdoor storage will be for tenants
of the building.
The Planner noted that since the Planning Commission meeting the
applicant has submitted a site plan that better reflects what is being
proposed. In reviewing the revised site plan, it appears that the proposed
outdoor storage complies with size requirements outlined in the Code. He
also noted that the Fire Marshal has reviewed the site and finds it to be in
compliance with the Fire Code.
Montour asked if the outdoor storage area would be fenced. The City
Planner replied that it is fenced.
3
