Resolution declared adopted. <br />VARIANCE & Blesener opened the Public Hearing to consider application for a Variance <br />CUP — from the minimum lot width standards in the 1 -1 District and Amendment <br />180 RYAN to Conditional Use Permit for outdoor storage for 180 Ryan Drive <br />DRIVE — requested by Roger Lillemoen. It was noted that the City Planner and the <br />LILLEMOEN Planning Commission recommended approval subject to compliance with <br />City Code requirements. <br />The City Planner reported that Mr. Lillemoen has requested a Variance to <br />redefine the front yard of his property at 180 Ryan Drive to the Spruce <br />Street frontage in order to accommodate outdoor storage in a side yard. <br />The Planner noted that the Code says that outdoor storage is not allowed <br />beyond the building line regardless of whether the frontage is considered <br />the front or a side yard. Therefore, the Variance that is being considered is <br />to allow outdoor storage in a side yard abutting a public street. The <br />Planner noted that the storage area in question is in the northeast corner of <br />the property and is approximated 43 feet from the paved surface of Ryan <br />Drive. <br />The Planner noted that when considering a Variance request, the City must <br />find that the proposed use is reasonable and there are practical difficulties <br />in complying with the ordinance requirements. These difficulties must be <br />unique to the property, not caused by the applicant, non - economic in <br />nature, consistent with the intent of zoning regulations, and not in conflict <br />with the neighborhood. The Planner pointed out that this parcel is subject <br />to significant setback restrictions due to the long frontage from both Ryan <br />Drive and Spruce Street, and the rear yard opposite Ryan Drive is <br />restricted given the shallowness of the lot. The Planner also pointed out <br />that there are other corner lots in Ryan Industrial Park that have outdoor <br />storage encroach toward the street. The Planner indicated that the amount <br />of outdoor storage being requested is far below the 60% threshold allowed <br />for by Code and is about 25% of the lot overall. <br />Blesener noted the discussion at the Planning Commission meeting <br />relative to the temporary structure on this property. The City Planner <br />indicated that this tarp structure does not comply with the Code, and also <br />noted that outdoor storage cannot exceed the height of the screening fence. <br />5 <br />
