MINUTES <br />CITY COUNCIL <br />JULY 24, 2013 <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2013 -7 -132 — APPROVING AN AMENDMENT <br />TO CONDITIONAL USE PERMIT FOR OUTDOOR STORAGE AT <br />180 RYAN DRIVE, ROGER LILLEMOEN, SUBJECT TO <br />COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY <br />PLANNER AS OUTLINED IN HIS JULY 5, 2013 REPORT <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />ZONING Blesener opened the Public Hearing to consider Amending the Zoning <br />CODE — Code relative to Single- Family Accessory Uses and the Definition of <br />SINGLE - Family. It was noted that the City Planner and the Planning Commission <br />FAMILY recommended approval of an Amendment to Accessory Use Provisions <br />ACCESSORY in the R -1 Zoning District relative to boarding or renting of rooms as <br />USES proposed by the City Planner in his July 8, 2013 report. <br />The City Planner reported that given code enforcement issues that have <br />arisen with some single - family rental properties, City staff has asked that <br />consideration be given to amending the definition of family and /or <br />accessory uses allowed in the Single- Family (R -1) Zoning District. The <br />City Planner noted that a year or two ago, the City Attorney updated the <br />definition of family to address Federal Fair Housing requirements, and the <br />preference is to address current issues related to boarding through an <br />amendment to single- family accessory uses. The Planner noted that a <br />boarder is one who rents sleeping rooms, but shares cooking facilities. <br />The Planner explained that the occupancy of single family homes can raise <br />issues when the resident population fails to utilize the unit as a common <br />household. Problems include inadequate indoor facilities or outdoor <br />spaces, such as recreational space, parking space, and storage space. The <br />Planner noted that the purpose of the single family zoning regulations is to <br />maintain conditions which are expected by other property owners of single <br />family neighborhoods. <br />The Planner reported that to address the issues of concern, h is proposing <br />an amendment of Section 902.010 G. relative to boarding and renting of <br />7 <br />
