MINUTES <br />PLANNING COMMISSION <br />APRIL 9, 1992 <br />for up to 15 vehicles. Keis asked what would prevent <br />that amount from increasing. <br />DeLonais pointed out that O'Connell already has some <br />loaner vehicles and asked why the City needs to approve <br />the additional vehicles. <br />O'Connell replied that he is requesting a MN Auto <br />Dealers License. With this license he will not have to <br />pay sales tax on his loaner vehicles until they are <br />sold. The cars that he purchases usually run between <br />$5,000 and $6,000, so this will be quite a savings. <br />The Planner noted that a Dealer's License requires a <br />conditional use permit. <br />Garske asked what happens if O'Connell starts doing <br />better selling cars than repairing them. <br />O'Connell reported that he has $500,000 invested in his <br />body shop and has no intention of converting to an auto <br />sales business. <br />Keis asked if approval of this CUP would set any <br />precedents that could result in Country Drive becoming <br />a dealership area. <br />The Planner pointed out that the City can place <br />whatever conditions it feels necessary on the <br />Conditional Use Permit. The Planner further reported <br />that Public Works and Steve Grittman have discussed the <br />Suburban Auto site and there are some site conditions <br />that are not in compliance with Code requirements. For <br />example, some parking areas are not paved and there is <br />some curbing missing. One of the things that the City <br />can require as part of the CUP process, is that the <br />site be brought into conformance with the Code. <br />O'Connell felt that the condition of his property was <br />better than most of the other properties in the area. <br />The City Planner replied that he was not disputing <br />this, but merely pointing out that it is the ability of <br />the City to require that the site be brought into <br />conformance with current standards. <br />Bob DeBace, property owner in the area, stated that he <br />understands what Mr. O'Connell is requesting and has no <br />problem with the request, as long as the site does not <br />turn into an car sales lot. <br />O'Connell reported that he purchases used vehicles with <br />approximately 25,000 miles for use as loaner and <br />Page 5 <br />
